1. Scope and Lendlyy's role
Lendlyy operates a platform where private individuals can lend items to other private individuals for a fee. The rental agreement is concluded exclusively between the users involved. Lendlyy is not a party to it, is not a lender of the item and is not an insurer.
2. Private use
Lendlyy is intended for private individuals. Commercial renting is not permitted without prior written consent; such accounts may be blocked.
3. Booking flow
- The renter requests a specific period.
- The lender may accept or decline within 24 hours.
- Acceptance concludes the rental agreement between the parties.
- The exact pickup address is shared only after acceptance.
4. Handover and return protocol
Both parties document the item's condition at handover and at return using photos in the app, and both confirm handover and return in the app. These photos and confirmations serve as evidence, particularly in a dispute.
5. Renter liability and cap
The renter is liable for damage occurring during the rental period for which they are responsible, up to the maximum amount stated in the listing and expressly accepted before booking (the "liability amount"). This cap is a contractual limitation of liability and not insurance.
If damage is established and the liability amount becomes due in whole or in part, ownership of the damaged item passes to the renter upon full payment, unless the parties agree otherwise.
6. Disputes and Lendlyy's decision
If the lender reports damage, the renter is given the opportunity to respond. Lendlyy compares the handover and return photos and both statements and decides on the amount payable within the liability cap. The decision is communicated to both sides with reasons. Recourse to the courts remains unaffected.
7. Lendlyy's fee
For every concluded rental Lendlyy charges €0.50 plus 5% of the rent, deducted from the lender's payout. Listing items is free.
8. User obligations
- Listing information must be truthful; photos must show the actual condition.
- Prohibited, dangerous or unsafe items must not be offered.
- Items must be used carefully and as intended, and returned on time.
9. Cancellation
The renter may cancel free of charge up to 24 hours before the rental starts. [Further cancellation and refund rules to be added once payments are live.]
10. Blocking and termination
Lendlyy may temporarily or permanently block accounts for breaches of these terms, suspected fraud or unpaid damage claims.
11. Lendlyy's liability

12. Final provisions
